Ferrari Esports Series Regulation

TERMS AND CONDITIONS

These terms and conditions are issued by Ferrari SpA, hereby referred to as ‘us’, ‘we ’or ‘our’ for users of the website (the ‘Site’) and our services including online communities, broadcasts and tournaments.

These conditions may be updated at any time without notice. Additional terms for specific aspects of our products and services will be provided as required (e.g. tournament rulebooks, Discord code of conduct).

PLEASE NOTE THAT THE WEBSITE AND THE TOURNAMENT ARE INTENDED FOR OVER 16’S ONLY.

PARTICIPANTS MUST BE AT LEAST 16 (SIXTEEN) YEARS OF AGE AT THE TIME OF REGISTRATION, AND, IF PARTICIPANTS ARE UNDER THE AGE OF 18 (EIGHTEEN) YEARS OF AGE, PARTICIPANTS HAVE TO OBTAIN PRIOR CONSENT FROM THEIR PARENTS OR THE PERSON EXERCISING PARENTAL RESPONSIBILITY IN ORDER TO PARTICIPATE IN THIS CONTEST.

YOU MAY NOT REGISTER TO PARTICIPATE, OR PARTICIPATE IN ANY TOURNAMENT, COMPETITION OR OTHER EVENT HOSTED ON THIS WEBSITE IF YOU ARE UNDER THE AGE OF 16. FERRARI RESERVES THE RIGHT IN ITS ABSOLUTE DISCRETION TO REQUIRE PROOF OF AGE AND/OR TO REFUSE PARTICIPATION TO ANY PERSON IT BELIEVES IS UNDER THE AGE OF 16.

In the event that the same subject has participated in the Competition through different e-mail addresses or fictitious names, it will be excluded from the Competition and no prize will be awarded to it, in accordance with the provisions of this Regulation.

In any event, the following may not participate in the Contest:

  1. Individuals residing in countries subject to international sanctions and/or countries whose legislation provides for specific requirements other than those required by Italian law and/or this Regulation;
  2. people who can not obtain visas or permits to travel abroad, either for personal reasons or for reasons dependent on the State in which they are resident;
  3. minors under the age of 16, minors between the age of 16 and 18 without the prior consent of their legal guardians;
  4. employees of the Promoter, Delegated Subjects, its consultants and all those who have contributed to the realization of the Contest “Ferrari Esports Series”.
  5. subjects who have entered the Contest through registrations that do not comply with the provisions of this Regulation;
  6. subjects who use computer automation or so-called “robots” aimed at circumventing the control systems on participation in the Contest or aimed at simulating interaction with the Site and/or the Game, as defined above.

In the event that the same subject has participated in the Competition through different e-mail addresses or fictitious names, it will be excluded from the Competition and no prize will be awarded to it, in accordance with the provisions of this Regulation.

The Promoting Company and the Delegate reserve the right to verify, at any time, the possession of the requirements to participate in the Contest (also by requiring a valid identification document). It being expressly understood that, in the event of irregularities in the participation in the Contest, or the lack of the required

EVENTS

Throughout the duration of the 2024 Ferrari Esports Series, a user may require access to additional content, such as Downloadable Content (DLC) or Modified Files (Mods), which may come at a cost. It is the sole responsibility of the user to ensure that they own the content required to take part in the 2024 Ferrari Esports Series and if the user does not own the required content, they will be required to purchase the content at their own expense.

Any specific Downloadable Content (DLC) and/or Modified Files (Mods) that are required will be clearly communicated to the user when registering to participate in a hotlap qualifier.

WEBSITE

Use of the Site in its entirety is at your own risk. By using the Site or by creating a Site account, you agree that we are not responsible for any damage or loss as a result of your access to the Site. You may not make any attempt to gain unauthorised access to protected areas of the Site or to damage any areas of the Site including its performance. Anyone found to be taking damaging actions towards the Site will be reported to the relevant local law enforcement authorities.

By using the Site you agree to hold us harmless from any claim arising from your activities on the Site.

Access to the Site is given to the named account holder only, you may not allow any other person to access your account on your behalf. On registration you are required to ensure that all information provided is accurate.

Your account is not transferable to any other user. You are responsible for any damage caused by misuse of your account by yourself or any other person who has been given access. By creating an account on the Site, you consent to certain information about you being made public to other users in community areas of the Site, such information may include your username, country of residence, game performance data and other information that you will be informed about on joining.

We reserve the right to terminate your access to the Site for any reason with or without prior notice. Similarly we reserve the right to terminate any aspect of the Site or service as required.

The Site may contain links to external websites and resources, we take no responsibly for the content of these external resources and following these links is done so at your own risk.

All content on the Site is copyright of us and Speed Capital Ltd. and may not be reproduced without permission.

The Site and associated services have aspects which are community lead (e.g. Discord) and therefore opinions published belong to the original posters, not necessarily to us. We accept no responsibility for errors, omissions or inaccuracies on the Site.

Community areas of the Site may be moderated by our staff, we reserve the right to remove content that may fall into the below categories:

The prize that will be awarded to each of the 10 (ten) winners of the “Community Cup” will be a No. 1 Ferrari 250 GTO Wheel Add-On, each with a commercial value of €327,87.

The final draw among all Participants who did not result as Winners of the skill contests will be for No. 10 (ten) Burago GT car model, each with a commercial value of €81,97 (each the “Prize Draw”).

Each Participant may only win one prize.

The Promoting Company reserves the right at all times to verify the identifying references entered by the Participant, as well as the right to perform all activities necessary to verify the possession of the requirements to participate in this Contest and consequently reserves the right to exclude individuals who do not meet them.

If, at the outcome of the verifications, the Participant is found to be registered through multiple addresses, the same will be excluded from the Contest and the prize won, if any, will be awarded, to the subjects on the list of reserves, or to the non-profit organization designated for this purpose.

In light of the above, the total value of the Prizes is Euro €15.932,00; each prize is not exchangeable and is not convertible either in money or in different goods or services even if of lesser value.

Who We Are - This Privacy Policy is issued for our users by Ferrari SpA, hereby referred to as ‘us’, ‘we ’or ‘our’. Speed Capital Ltd, operating as SimGrid, and with the website domain www.thesimgrid.com, has been appointed as the Data Processor by Veloce Esports Limited, who are organising the tournaments for Ferrari SpA. If you have any queries regarding this policy or the use of your data, you can contact us on info@esportsseries.ferrari.com.

Why We Need Your Personal Data – Users may browse public areas of the site without providing any personal information, however to use interactive features or to use our products/services you will be required to provide some personal details.

We process your personal data to provide you with access to our services (e.g. tournaments and online community). We only request data from you that we have deemed essential for these purposes. We process your personal data as part of your contact with us to participate in our services and we process your data for marketing purposes solely where you have said it is ok to do so.

If you attend future live events, we may require additional personal data from you. We may also be required to process your data, by publishing winners, and by notifying Ferrari, in the event that we make payments or issue prizes as part of your participation.

Where We Get Your Data From – Only from you. We do not buy in data from any third parties, or sell on your data to any third parties. The only data we have from you is either provided by you, or generated by participating in our services (e.g.participating in a tournament and recording results).

Cookies - Cookies are text files placed on your computer to collect standard internet log information and visitor behaviour information. This information is used to track visitor use of the website and to compile statistical reports on website activity. For further information visit or . However in a few cases some of our website features may not function as a result.

Other websites - Our website contains links to other websites. This privacy policy only applies to this website so when you link to other websites you should read their own privacy policies.

Retaining Your Data - We retain that data while you remain a participant with us to allow for future bookings and to track your historical performance. After 2 years of not using our services (defined as participating in an online tournament or accessing your website account) we will notify you that your data will be automatically removed, followed by account deletion 2 weeks after that notification. To retain your account, you simply need to log in to your website account.

Please see the section under “Your Rights” for requests to manually remove your data.

Data Sharing – We use 3rd party software systems in order to process your data, we select systems that are either based in the EU, or have suitable protections through EU-US privacy standards. We have listed all possible systems that may hold your data and why below, note that any requests to modify/remove your data will also be shared with these organisations as part of our data flow:

WHO DO WE SHARE YOUR DATA WITH

Apart from the organisations set out above, who provide processing services as part of operating the website and operating the tournaments, we will also publish on our website, and provide to Ferrari names of prominent tournament participants including winners, section winners and prize winners. Your consent to this is a condition of your being able to participate in the tournaments.

YOUR RIGHTS

Under the General Data Protection Regulation, and associated laws, the following rights apply to you and your data:

Right to be informed – This right means that you are entitled to know how we handle your data and is covered through this privacy policy.

Right to access – You can access most of your information through your tournament account which will show your personal details and participation history. If you wish to access additional information about your data, please see the section on making requests below.

Right to rectification – You can update most of your personal details through your tournament account. If you wish to make further updates that cannot be managed through self-service, please see the section on making requests below.

Right to erasure – We automatically remove your data after 2 years of inactivity. Should you wish to remove your personal data before that time, please see the section on making requests below.

Right to restrict processing – As your personal data is required as part of your service with us, the main applicable restriction will be for use of your data for marketing communications, you can manage your marketing preferences on your tournament account. Note that this does not restrict the ability to send you specific communications about tournaments you have entered (e.g. information on how to participate in the tournament, join servers, record scores etc).

Right to data portability – You will soon be able to download a CSV file or your personal details and attendance history direct from the tournament website, in the meantime, please see the section below on making requests.

Right to object – You have the right to object to direct marketing, you can manage these preferences in your tournament account.

Rights related to automated decision making and profiling – We do not use any automated decision making or profiling.

Making Requests - To make any requests under the above rights, please contact Responses will be completed within 30 days from the request being received except where the request is manifestly unfounded, excessive or repetitive, in which case the request may be rejected, further information requested, or a fee charged. In any of these cases you will be notified of our decision along with your next steps and how to appeal the decision.

Complaints – If you have any objections or concerns over your data, in the first instance we would ask you to get in touch with us to resolve any concerns please contact us via this e-mail address: info@esportsseries.ferrari.com If we are unable to resolve your concerns, then we will advise you to make contact to the local supervisory body, e.g. Information Commissioners Office in the UK.

We may change this policy at any time but will ensure that users of the Site are notified.
